False sick note and absence inquiry
A suspicion that an employee on sick leave is working elsewhere or at an event can only be resolved by facts. But privacy sets the limit.
Limits
Health data is special-category personal data. There is no intrusion into the person's health condition or home; only factual observation in public places showing the alleged activity is carried out. The validity of a sick note is assessed under health legislation and with legal counsel.
Proportionality
This type of inquiry should be a last resort; internal controls, workplace physician processes and written requests should be tried first. Where needed, proportionate and short-term observation is suggested.
