General principles
An employer may carry out a degree of monitoring at work for security, efficiency and legal obligations. But monitoring must rest on a legitimate purpose, be proportionate and employees must be informed clearly in advance. The rules on processing personal data are set out in KVKK.
Cameras
Workplace security cameras are common in work areas, but they must not be placed in privacy areas such as changing rooms, toilets and rest areas. The presence and purpose of cameras should be announced to employees and the retention period and access rights of recordings set.
Email and devices
Monitoring company email and devices may be possible with a prior written policy and notice and in a proportionate way; interference with an employee's private correspondence, however, is limited. The policy should be in writing.
Detectives and inquiries
Commissioning an outside inquiry on suspicion is also subject to these principles; scope needs to be set with legal counsel. See the corporate investigations and KVKK pages for details. This article is general information and not legal advice.
