Important
This article is a general overview and not legal advice. Article numbers and content may change; consult your lawyer for your concrete case.
General framework
The Turkish Criminal Code treats acts such as violation of confidentiality of communication, listening to and recording conversations between people, violation of the privacy of private life and unlawful recording of personal data as separate offences (for example arts. 132-136). The elements, penalty and application of each offence differ.
If a device is found
Do not touch the device, photograph and record it and contact a lawyer. A criminal complaint can be filed with the prosecutor; the device is taken as evidence by the police or an expert. Rather than guessing who placed it, it is important that the device and trace records are examined by the competent authorities. See the what to do if a device is found page for the steps.
Your own recordings
Where you yourself are a party to a conversation, the evidential value and lawfulness of a recording may be debatable and varies by case. It is important to consult a lawyer on this before recording.
Why TSCM?
For the legal process the existence of the device needs to be documented technically. A TSCM sweep finds the device without disturbing it, keeps position and measurement records and gives your lawyer a usable detection report.
